Is asylum accommodation exempt from HMO licensing?
Do not rely on the proposed Houses in Multiple Occupation (Asylum-Seeker Accommodation) (England) Regulations 2023 as an exemption. The UK Parliament procedure record confirms that the draft instrument was withdrawn on 7 February 2024 and could not become law. The withdrawal also appears in the Commons Votes and Proceedings.
An earlier version of this article incorrectly described that proposal as enacted. Its proposed dates and two-year exemption are not a basis for operating an unlicensed property. Establish the current statutory position and any genuine exemption for the particular building with Portsmouth City Council and a qualified adviser.
Accommodation for people seeking asylum can take different forms. A family occupying a self-contained home is not the same licensing case as unrelated households sharing amenities. The actual property, households, facilities and occupation determine the assessment; residents' immigration status alone is not a licensing decision.
Which Portsmouth HMO licence should an investor check?
Portsmouth operates mandatory and additional HMO licensing, including an additional scheme introduced on 1 September 2023. Use the council's current licence guide and check the precise address and layout.
| Property situation | Route to check with the council |
|---|---|
| Shared HMO with five or more people from two or more households | Mandatory licensing, subject to the statutory scope and exemptions |
| Shared HMO with three or four people from two or more households | Portsmouth additional licensing |
| HMO within a purpose-built self-contained flat in a block of three or more flats | Additional licensing can apply; do not use the house threshold alone |
| Certain buildings converted into self-contained flats | Section 257 licensing may apply to the building, with separate licences needed for individual HMOs within it |
The council's additional licensing page sets out covered occupation types and application evidence. Its section 257 guide explains the converted-building route. Confirm applicable exemptions rather than assuming that every rented home needs an HMO licence.
A licence also does not grant planning permission. Obtain planning history and written advice about the proposed use where needed. Use the HMO licence evidence pre-check to organise the evidence and unresolved questions.
Safety standards still matter
The Home Office's guide to dispersal accommodation describes accommodation providers, standards and ways for residents to report problems. A provider's inspection process should be checked alongside the property's housing, fire and licensing obligations.
It would be incorrect to say that a council automatically loses its housing-enforcement powers whenever asylum seekers occupy a property. GOV.UK's HMO guidance describes local councils' role in enforcing HMO standards. The appropriate regulator and enforcement route depend on the issue and premises.
Before signing a provider agreement, assemble a property file containing the licence or evidenced exemption, permitted occupancy, floor plan, relevant fire assessment and action closure, safety certificates, insurance confirmation and repair responsibilities. Identify who must arrange work, who pays and how the owner obtains evidence of completion.
Assess the provider agreement, not an assumed demand guarantee
Local asylum-support headcounts are not a rent offer for a particular property. This article does not use an unverified local forecast to infer future occupancy or returns. If a proposal includes demand statistics, request the original official table, reporting date and definition; distinguish people receiving support from occupied property units.
Read the actual contracting entity and payment obligations. A contract with an accommodation provider is not necessarily a direct government guarantee to the property owner. Ask a solicitor to examine payment commencement, deductions, rent suspension, break clauses, repair allocation, damage claims, access, subletting permissions and handback condition. Obtain the lender's and insurer's written acceptance of the proposed use and agreement.
Hypothetical payment-delay stress test
Assume a provider offers £2,400 a month, the owner's retained annual operating costs are £4,800 and annual finance payments are £12,000. The scheduled annual cash balance before tax and capital expenditure is:
£2,400 × 12 − £4,800 − £12,000 = £12,000
If three payments are delayed, £7,200 of expected receipts is temporarily unavailable. That is a liquidity scenario, not proof the rent is permanently lost; model default separately. Keep cash available for essential maintenance and safety work even while a payment dispute is unresolved. These figures are illustrative, not Portsmouth market rents or provider terms.
Compare the agreement with the costs and risks of ordinary letting using the gross and net yield calculator, and retain the contract stress test alongside it. For further distinctions between provider promises and insurance, see HMO guaranteed rent explained.
